1. Data controller
The controller responsible for the processing of personal data collected through this website is Emir Palacios, an Argentine national residing in Prague, Czech Republic. Contact: emirek.music@gmail.com.
No Data Protection Officer has been appointed, as this is not required for the processing activities currently carried out through this website.
2. Personal data we process
If a user contacts us by email, only the data voluntarily included in the message will be processed:
- Email address
- Message content
- Any data the user chooses to include voluntarily
The website may also process limited technical data necessary for operation and security, such as IP address, browser information, server logs, and cookie consent preferences.
The website does not provide user accounts, public comments, newsletters, analytics tracking, advertising pixels, or a contact form.
3. Purpose of processing
- Responding to inquiries sent by email.
- Operating, maintaining, and securing the website.
- Managing cookie consent and blocking third-party embedded media until consent is given.
The site does not use analytics tools, advertising cookies, or marketing tracking pixels.
4. Legal basis
Processing of data received by email is based on the controller’s legitimate interest in responding to inquiries addressed to him and, where applicable, on pre-contractual measures requested by the data subject.
Processing of limited technical data, including IP addresses and server logs, is based on the controller’s legitimate interest in operating, maintaining, and securing the website.
The use of non-essential cookies and third-party embedded media is based on the user’s explicit consent given through the cookie preferences panel.
5. How data is processed and retained
The site does not use a contact form. Messages are sent directly from the user’s email client to the controller’s mailbox. Received messages are retained only for as long as necessary to handle the inquiry, unless a legal obligation requires a different retention period.
Technical server logs are retained by the hosting provider for a limited period necessary for security, troubleshooting, and service operation. As a general guideline, these logs should not be retained longer than necessary for those purposes.
Cookie consent preferences are retained for up to 365 days, unless the user changes or withdraws consent earlier.
6. Recipients, processors, and international transfers
Personal data may be processed by the following categories of recipients or processors, only where necessary for the purposes described in this policy:
- Hosting provider: stores and serves the website and may process technical data such as IP addresses and server logs as a processor on behalf of the controller.
- Complianz WordPress plugin: manages cookie consent locally within the WordPress installation.
- Google/YouTube: may process data only if the user chooses to enable embedded YouTube media.
The processing carried out by the hosting provider should be governed by a data processing agreement in accordance with Article 28 GDPR.
The controller is established in the European Union, in Prague, Czech Republic, and the website is hosted with a provider located in Argentina. This involves an international transfer of data outside the European Economic Area to the hosting provider. Argentina is recognised by the European Commission as providing an adequate level of personal data protection, so transfers to Argentina can take place on the basis of that adequacy decision.
7. Security measures
Reasonable technical and organizational measures are applied to protect personal data against unauthorized access, loss, or alteration, including site-wide encrypted connections through HTTPS, limited administrative access, and cookie consent controls for embedded third-party media.
8. User rights
Any data subject may exercise their rights of access, rectification, erasure, objection, restriction of processing, and portability by writing to emirek.music@gmail.com.
Users also have the right to lodge a complaint with the competent supervisory authority. The competent supervisory authority in the Czech Republic is the Czech Office for Personal Data Protection (Úřad pro ochranu osobních údajů, ÚOOÚ). Residents of other EU countries may also lodge a complaint with the data protection authority of their country of residence, place of work, or place of the alleged infringement.
9. Minors
This site is not directed at minors, and no personal data from minors is knowingly collected without verifiable consent from their legal guardians.
10. Cookies and embedded media
The site uses a cookie management panel provided by the Complianz WordPress plugin. It allows users to accept, reject, or customize non-essential cookies before they are set. Cookie preferences can be changed at any time through the cookie settings link available on the site.
Embedded YouTube media is blocked until the user consents to embedded media cookies.
11. Changes to this policy
This policy may be updated to reflect regulatory or operational changes. The date of the last update appears at the top of this document.
